MyCarePortal (MCP) 

Terms and Conditions

1. IT IS IMPORTANT THAT YOU READ THESE TERMS AND CONDITIONS CAREFULLY. THIS AGREEMENT IS A LEGAL AGREEMENT BETWEEN YOU AND LONDON HEALTH SCIENCES CENTRE (“LHSC”). 

These terms and conditions of use for the MCP constitute a legal agreement and are entered into by and between you, as a user of the MCP (“you” or “User”) and “LHSC”. The following terms and conditions, together with any documents and/or additional terms that are incorporated by reference, including, but not limited to the MCP policies and procedures (the “MCP Policies”) set out in the MCP (collectively, the “Terms”), govern your access to and use of the MCP. 

BY USING THE MCP, YOU ACCEPT AND AGREE TO BE BOUND AND COMPLY WITH THESE TERMS AND OUR PRIVACY POLICY, FOUND AT https://mycareportal.ca/privacy, INCORPORATED HEREIN BY REFERENCE. IF YOU DO NOT AGREE TO THESE TERMS OR THE PRIVACY POLICY, YOU MUST NOT ACCESS OR USE THE MCP. 

By using the MCP (and subject to Section 6 below), you represent and warrant that you are of the legal age of majority or are a parent or legal guardian of a minor under applicable law to form a binding contract with LHSC and meet all of the foregoing eligibility requirements. If you do not meet all of these requirements, you must not access or use the MCP. 

LHSC reserves the right in its sole discretion to revise and update these Terms from time to time. Any and all such modifications are effective immediately upon posting and apply to all access to and continued use of the MCP. You agree to periodically review these Terms in order to be aware of any such modifications and your continued use shall be your acceptance of these. 

The availability and content of the MCP may be changed, withdrawn, or terminated at any time in LHSC’s sole discretion without notice. LHSC will not be liable if, for any reason, all or any part of the MCP is restricted to users or unavailable at any time or for any period. 

2. Purpose of the Portal  

MCP is a web-based portal and application managed by LHSC and its service providers.  It allows you to view a selection of your personal health information in your health record made available by the Hospitals in London and the Region that are participating in and making use of MCP, each individual Hospital a (“Contributor”) or collectively (“CONTRIBUTORS”).   

3.  Your use of information  

Your enrollment in MCP does not constitute and is not otherwise a substitute for medical care, and you may only use the MCP (or any part thereof) as a reference or informational tool for personal use.  

MCP is not your official health record and the information available for you to view through MCP is not your complete health record. Please visit https://mycareportal.ca/FAQ for further information regarding health information that is not included in MCP and the different functions available. In addition, some of the data from your health record may be subject to delays before it is made available to you through MCP.   Information not available in MCP may be requested through the Health Information Management department of the hospital where you received care. 

4. MCP Provided Only as a Convenience 

Enrollment in MCP is voluntary and will not affect the level of care that you will receive from LHSC and/or CONTRIBUTORS.   MCP is provided by LHSC and CONTRIBUTORS as a convenience to support your participation in your own care journey. If you decide not to participate in MCP, your decision will not affect the care that you receive from LHSC and/or the CONTRIBUTORS.  

5. MCP Maintenance and Interruptions 

MCP may periodically be unavailable due to planned maintenance activities necessary to ensure the continued security and reliability of the portal.  MCP may also experience unexpected system outages, which may be resolved during business hours (Monday to Friday, 0800-1600 excluding statutory holidays).  Any outages or interruptions that occur outside of these hours will be investigated and resolved during business hours on the next business day.  You should note that the records made available to you via MCP are under the control of the service provider and/or the CONTRIBUTORS and access may be limited in accordance with the Freedom of Information and Protection of Privacy Act (FIPPA) and the Personal Health Information Protection Act (PHIPA), service provider and/or the CONTRIBUTORS record management policies and procedures. 

6. Enrollment for Your MCP Account and Responsible use of MCP  

Information on how to enroll for an MCP is available here: https://mycareportal.ca/ 

You must be 16 years of age or older to enroll in and obtain an MCP Account.   If you are under the age of 18 a parent or guardian must agree to these Terms of Use and Privacy Policy on your behalf.    

Your account will consist of your e-mail address, which is used as the username, and a password. When requesting enrollment in MCP, you hereby agree (i) to provide true, accurate, current and complete information about yourself as requested in the enrollment form; and (ii) to maintain and promptly update such information to ensure it remains true, accurate, current and complete. If the LHSC or any Contributor has reasonable grounds to suspect that any information provided by you is untrue, inaccurate, not current or incomplete, LHSC has the right to deny, suspend or terminate your Account and your access to MCP. 

You are responsible for maintaining the security and confidentiality of the password used to access MCP, and for all activities that occur under your Username and Password. Choose a strong password that is not easily guessed and that is used exclusively to access MCP.  

You agree that you will not:  

(a) use or attempt to use MCP with an account, or a username and/or password that is not yours;  

(b) access or attempt to gain access to information other than your own information;  

c) share your password with any other person;  

(d) walk away from your device while still logged into MCP.  This could provide an opportunity for unauthorized individuals to view your personal health information; or 

(e) reproduce or distribute the MCP, or portions thereof, for any commercial or other purpose.  

If you learn or suspect that your Username or Password has been wrongfully used or disclosed, you must promptly contact the Oracle Health Consumer Support Center at 1-800-390-0123. to reset your MCP Password. To help maintain the security of your Password or account, you must sign out of your account at the end of each session.  

LHSC and CONTRIBUTORS, and their respective service providers will not be liable for any loss or damage arising from your failure to maintain the security or confidentiality of your MCP Account information. 

7.  Termination of Account 

LHSC reserves the right, in its sole discretion, to terminate your MCP Account at any time without providing notice to you, including but not limited to your actual or suspected unauthorized, unlawful or otherwise objectionable use of the MCP.  

In the event of any termination, you are no longer authorized to access MCP. The restrictions imposed on you with respect to material downloaded from MCP, and your obligations, LHSC’s rights and remedies, the disclaimers and limitations of liabilities defined in this Agreement, shall survive any discontinuance or termination of MCP or this Agreement.   You may also choose to discontinue your participation in MCP at any time by completing and submitting the MyCarePortal Unenrollment Form.  

If you have concerns about the termination of your account, you may contact the MyCarePortal support team at mycareportal@lhsc.on.ca or call and leave a voicemail at at 519-685-8500 ext. 58286. We aim to respond within three business days. 

8.  Disclosure of Information  

LHSC and CONTRIBUTORS may, at their sole and reasonable discretion, disclose any information to their service providers for operational purposes, and as otherwise necessary in accordance with or to satisfy applicable law, regulation, or legal process. All information stored in MCP resides in Canada.   Some support services are provided from the United States. 

9.  Privacy 

You agree to the terms and conditions of the MyCarePortal Privacy Policy, which is incorporated into and made part of these Terms.  

10.  Service Disclaimers and Limitations 

MyCarePortal is an information management tool provided as a convenience for Patients only, and is not a requirement for the provision of patient care by LHSC or a Contributor.   MyCarePortal does not provide medical advice, nor is the content intended to be a supplement to, nor a substitute for, professional medical advice, diagnosis, and treatment.  You and your health care provider are responsible for all medical treatment decisions.  You should consult your health care provider about any questions you may have regarding a medical condition, or the information provided by MyCarePortal.   If you have a medical emergency, call a physician, qualified health care provider, or 911 immediately. 

The content on the MCP is provided for general information purposes only. It is not intended to amount to advice on which you should rely. You must obtain more specific or professional advice before taking, or refraining from, any action or inaction on the basis of the content of the MCP. 

YOU ACKNOWLEDGE AND AGREE THAT THE INFORMATION AND MATERIALS PROVIDED THROUGH THE MCP ARE MADE AVAILABLE TO YOU SOLELY FOR INFORMATIONAL PURPOSES. ANY INFORMATION COMMUNICATED OR FEATURES OFFERED THROUGH THE MCP ARE NOT A SUBSTITUTE FOR SERVICES PROVIDED BY A HEALTHCARE PROFESSIONAL. NEITHER LHSC NOR THE CONTRIBUTORS HAVE REPRESENTED THE MCP AS HAVING THE ABILITY TO DIAGNOSE DISEASE, PRESCRIBE TREATMENT, OR PERFORM ANY OTHER TASKS THAT CONSTITUTE THE PRACTICE OF MEDICINE OR OF OTHER PROFESSIONAL OR ACADEMIC DISCIPLINES. LHSC, SUPPLIERS, AND THE CONTRIBUTORS MAKE NO REPRESENTATIONS ABOUT THE SUITABILITY, RELIABILITY, COMPLETENESS, AVAILABILITY, TIMELINESS, AND ACCURACY OF THE MCP OR ITS CONTENT. USE OF THE MCP IS SUBJECT TO APPLICABLE LAWS AND THE MYCAREPORTAL PRIVACY POLICY. THE MCP IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. LHSC, ITS SERVICE PROVIDERS, SUPPLIERS, CONTRACTORS, AND THE CONTRIBUTORS HEREBY DISCLAIMS ALL WARRANTIES AND CONDITIONS WITH REGARD TO THE MCP, INCLUDING ALL IMPLIED WARRANTIES AND CONDITIONS OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.  NEITHER LHSC, NOR THE CONTRIBUTORS WILL BE RESPONSIBLE FOR ANY ERRORS OR OMISSIONS IN THE MCP. YOU ASSUME ALL RISK FOR SELECTION AND USE OF THE MCP.   

11. Limitation of Liability and Indemnity 

To the maximum extent permitted by law, in no event shall LHSC, its suppliers, service providers, or any Contributor, and their respective physicians, other health care providers, officers, directors, employees, agents, licensors, and their respective successors and assigns, be liable for any damages of any kind, including without limitation, any direct, special, indirect, aggravated, punitive, incidental or consequential damages, and including without limitation loss of profits, failure to realize expected savings or loss of or unauthorized access to data, any loss or damages in the nature of or relating to medical injury, personal injury, wrongful death, improper diagnosis, inaccurate information, improper treatment or any other loss incurred in connection with use, misuse or reliance upon MCP or the Patient Data, or inability to use MCP, or arising from wrongful, unauthorized, or fraudulent third party access to Patient Data, regardless of the cause and whether arising in contract (including fundamental breach), tort (including negligence), or other legal or equitable theory. The foregoing limitation shall apply even if LHSC, its suppliers, or a Contributor, or their respective service providers knew of or ought to have known of the possibility of such damages. IF YOU ARE DISSATISFIED WITH ANY PORTION OF MYCAREPORTAL, OR WITH ANY OF THESE TERMS OF USE, YOUR SOLE AND EXCLUSIVE REMEDY IS TO DISCONTINUE USING MYCAREPORTAL. 

As a result, you agree to indemnify, defend and hold harmless LHSC, its suppliers, and CONTRIBUTORS, and their respective physicians, other health care providers, officers, directors, employees, agents, licensors, and their respective successors and assigns, from and against any and all claims, demands, liabilities, costs, or expenses whatsoever, including, without limitation, legal fees and disbursements, resulting directly or indirectly from (i) your breach of any of the terms and conditions of this Agreement, or (ii) access to, use, misuse, reliance upon or inability to access or use MCP. You will cooperate as fully as reasonably required in the defense of any claim. LHSC and CONTRIBUTORS reserve the right to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, provided, however, that you will remain liable for any such claim and for the costs of defense. 

12. Copyright, Trademark Notices and Limited License 

Other than your personal information and personal health information you understand and agree that the MCP and its entire contents, features, and functionality, including, but not limited to, all information, software, code, data text, displays, graphics, photographs, images, video, audio, music, broadcast, design, presentation, website layout, selection, and arrangement, are owned by the Company, its licensors, or other providers of such material and are protected in all forms by intellectual property laws including, without limitation, copyright, trademark, patent, trade secret, and any other proprietary rights.  

LHSC and CONTRIBUTORS names, logos, and all related names, logos, product and service names, designs, images, and slogans are trademarks of LHSC, the applicable CONTRIBUTOR, or their respective affiliates or licensors.  You must not use such marks without the prior written permission of LHSC. Other names, logos, product and service names, designs, images, and slogans mentioned, or which appear in the MCP are the trademarks of their respective owners. Use of any such property, except as expressly authorized, shall constitute an infringement or violation of the rights of the property owner and may be a violation of federal or other laws and could subject the infringer to legal action. Except as defined in this Agreement, any use of the content, including modification, transmission, presentation, distribution, republication, or other misuse of MCP or of its content, whether in whole or in part, is prohibited without the express prior written consent of the LHSC and/or CONTRIBUTORS.  

Subject to the Terms and Conditions of this Agreement, you are hereby granted a limited, non-transferable and non-exclusive license to access, view and use MCP and its content for your personal, non-commercial use. You are granted the right to download, store and/or print single copies of items from MCP for your personal, non-commercial use, provided that you maintain all copyright and other notices on MCP content.  You shall not directly or indirectly reproduce, compile for an internal database, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material within the MCP, in any form or medium whatsoever  

You are not permitted to modify copies of any materials from the MCP nor delete or alter any copyright, trademark, or other proprietary rights notices from copies of materials from the MCP. You must not access or use for any commercial purposes any part of the MCP. 

If you print off, copy, or download any part of the MCP in breach of these Terms, your right to use the MCP will cease immediately and you must, at our option, return or destroy any copies of the materials you have made. You have no right, title, or interest in or to the MCP or to any content on the MCP, and all rights not expressly granted are reserved by the LHSC. Any use of the MCP not expressly permitted by these Terms is a breach of these Terms and may infringe or violate copyright, trademark, and other intellectual property or other proprietary laws. 

13. General Legal Terms and Conditions 

 13.1Governing law and jurisdiction 

MCP is managed by LHSC and CONTRIBUTORS from their offices within the Province of Ontario, Canada. You agree that all matters relating to this Agreement, or your access or use of MCP and its content shall be governed by the laws of the Province of Ontario and the laws of Canada applicable therein.  You agree and hereby submit to the exclusive jurisdiction of the courts of the Province of Ontario with respect to all matters relating to your access and use of MCP and the content as well as any dispute that may arise therefrom.  

13.2 Waiver 

Any consent by LHSC and/ or CONTRIBUTORS to, or waiver of, a breach of this Agreement which you have committed, whether express or implied, shall not constitute a consent to, or waiver of any other, different or subsequent breach. 

13.3 Severability 

The invalidity or unenforceability of any provision of this Agreement or any covenant contained herein shall not affect the validity or enforceability of any other provision or covenant contained herein and any such invalid provision or covenant shall be deemed severable from the rest of the Agreement.  

13.4 Questions Related to MCP

13.5 Entire Agreement 

This is the entire Agreement between you and LHSC sits relating to your access and use of MCP.  

13.6 Modification of Terms  

LHSC and/or your CONTRIBUTORS may change these Terms at any time without advance notice to you. You are responsible for regularly reviewing these Terms. Your continued use of MCP constitutes your acceptance of the revised Terms. 

13.7 Feedback 

LHSC and CONTRIBUTORS welcome your suggestions to improve MCP. If you provide feedback to LHSC and CONTRIBUTORS, you agree that such feedback, including all ideas and concepts within the feedback, shall be the property of LHSC and CONTRIBUTORS. 13.8 No Unlawful or Prohibited Use 

You may not use MCP for any purpose that is unlawful, immoral or otherwise prohibited by these Terms. You may not use MCP in any manner which could damage, disable, overburden, or impair MCP or interfere with any other party's use and enjoyment of MCP. You may not obtain or attempt to obtain any materials or information through any means not intentionally made available or provided to you through MCP.

13.10 External Links 

In order to provide you with greater value, LHSC and/ or the CONTRIBUTORS may provide you with links to various third-party Web sites through the MCP. Even if a third-party affiliation exists between the LHSC and/or CONTRIBUTORS and that destination site, LHSC and/or CONTRIBUTORS exercise no authority over linked sites, each of which maintains independent privacy and data collection policies and procedures.  

The LHSC and/or CONTRIBUTORS assume no responsibility or liability for these independent methods or actions and are not responsible for the independent policies or procedures of destination sites. Similarly, LHSC and/or CONTRIBUTORS cannot take responsibility for the privacy initiatives or the content of such Web sites. These destination links are provided only for your convenience, and as such, you access them at your own risk.
